GENERAL TERMS OF SALES
Introduction:
The general terms of sales determine the relations between the company "IPower International Ltd" and its "CUSTOMERS".
Acceptance of the terms:
The "CUSTOMER" acknowledges having read the General Terms of Sales and also confirm their acceptance. Any order implies the acceptance of the General Terms of Sales of "IPower International Ltd" by the "CUSTOMER". The "CUSTOMER" recognizes to have the legal capacity or have the authorization of the right person to commit him in conformance with the present General Terms of Sales. Those General Terms of Sales will prevail over any other conditions appearing in any other document, except preliminary dispensation, explicit and written of "IPower International Ltd".
Equipments:
The features of the bestowed equipments can be modified or changed without any prior notice from the suppliers and/ or manufacturers. Any displayed pictures of any equipments are non contractual. "IPower International Ltd" declaims any and all liability as in regards to the use or ordered equipments. The proposed equipments meets the current French legislation. All the brands quoted by "IPower International Ltd" are registered trademarks by their respective owners. The characteristics of each equipments are only indicative and would not commit "IPower International Ltd".
Availability of equipments:
"IPower International Ltd" cannot be held responsible for the unavailability of any equipment due to the fact of the supplier and/or the manufacturer. All of the equipments are not stored in the stock of "IPower International Ltd" and his offer is then conditioned according to the availability of articles at the suppliers or the manufacturers. The possible stock shortages would not accordingly be the caused due to "IPower International Ltd". Every "CUSTOMER" is informed, by e-mail, for unavailability of any equipments.
Order:
The sale will be approved and concluded only upon acceptance of the order by the "CUSTOMER". The sale will only be approved and concluded as from the confirmation of the order. "IPower International Ltd" reserves the right to cancel any order of a customer with whom would exist a dispute concerning any payments of any previous order. The information expressed by the buyer, during the order taking commits himself: in case of error in the title of the address and phone number of the addressee, the seller could not be held responsible for impossibility in which the equipment could not be delivered. The sale of any equipment by "IPower International Ltd" is intended for the exclusive use of his "CUSTOMER". Consequently, any resale of any equipments is excluded except express authorization from "IPower International Ltd".

Payment mode and lead-time:
For the customers of Mauritius the following payment means are accepted: payments by credit transfer or cheque upon ordering. For others, only the payment by transfer is accepted. The delivery lead-time takes effect only as from the cashing of the amount “CUSTOMER”.
Delivery:
The "CUSTOMER" can choose the delivery of his order at his residential address or at the address of the addressee of his choice. Within the stocks availability, "IPower International Ltd" insures the deliveries under 24 in and 48/ 72 hours ( not contractual information). Subject to place an order before 11 am are considered as case of absolute necessity unburdening the seller of its obligation(bond) to deliver, war, riot, fire, strikes, accidents and the impossibility to be supplied. The equipments always travel at the risks and the dangers of the "CUSTOMER" addressee. Upon the arrival of the equipments, the "CUSTOMER" has to make immediate possible reserves with the carrier in case of any loss or any degradation. For reasons of availability, an order can be delivered several times to the customer. The "CUSTOMER" therefore settle only once the expenses of the delivery. If the customer wishes two (2) places of delivery, he should order twice with the bound expenses of deliveries.
Shipping fee:
The transport costs are not included in the pricing of the equipments and will be the subject to a separate invoicing according to the weight and of the destination.
Defective items:
If, within 3 days as from the reception of the equipments, the "CUSTOMER" notices an anomaly or a defect turned out in one among the equipments, the "CUSTOMER" after noticing the customer service, "IPower International Ltd" commits himself to make the exchange of the equipments from reception of said equipment.
Price:
The currency for payment is the Mauritius rupee. The prices are expressed exclusive of V.A.T and inclusive of V.A.T. The rates of the current V.A.T are of 15 %. The prices do not include shipment charges. "IPower International Ltd" reserves the right to modify its prices at any time but equipments will be invoiced on the basis of the current rates at the time of ordering t subject to availability to this date.
Confidentiality:
The information of the name specify information collected for the purposes of the remote sale is compulsory, this information being essential for the processing and the routing of the orders, the issuing of invoices and the warranty. Non sharing information entails the non-confirmation of the order. According to the law « I.C.T.A » ( Information and Communication Technologies Act), the processing of the name and specific information relative to the customers was the object of a statement and with the “Commission Nationale de l’Informatique et des Libertés” (CNIL) which regulates in French countries. The customer has (article 34 of the law of January 6th, 1978) a right of access, modification, rectification and to delete the data which concern him, which he can exercise towards "IPower International Ltd". Furthermore, "IPower International Ltd" commits himself not to communicate, free of charge or with counterpart, the address and phone number of his "CUSTOMERS" to a third party.
Disputes:
The present general terms of sale are governed by the Mauritian law. For all the challenges relative to the possible commercial disputes between "IPower International Ltd" and his "CUSTOMERS", the Commercial court of PORT LOUIS will be only competent.
Delay in payments:
In case of delay of payment, a 2% penalty fee by period of 15 days can be charged to the customer. A surcharge of 10% wil be applicable if amount is recovered by our attorney.
Issues with cheque:
In case of problem during the check deposit at the bank, a lump sum of Rs250.00 will be charged per representation.
Warranty:
The guarantee for latent defect or manufacturing defect cannot fall or be franchised, any appeal must be made towards the manufacturer.
In accordance with our general terms and conditions of sale, the goods purchased are granted a one (1) year standard warranty period. This warranty includes the problems inherent in the products, i.e. defects in material and workmanship with the exception of all wear parts (batteries).
For the Lowcost brand products, special terms and conditions apply depending on your purchase (6, 12, 24 or 36 months warranty).
For the products using consummables parts, the warranty will be void if the consummables used are not from the same brand as the product (usage of compatible) or if these parts are the cause of a problem the machine incurs.

Retention of ownership
"IPower International Ltd" keeps the full and whole property of equipments sold up to the whole payment of the invoice, principal expenses and of all taxes.
